The Punjab & Haryana High Court has ruled that in cheque bounce cases under Section 138 of the Negotiable Instruments Act, an appellant-convict is generally required to deposit at least 20% of the compensation amount while filing an appeal. The Court clarified that waiver of this statutory deposit can be granted only in exceptional and compelling circumstances, supported by valid reasons and evidence.
